REGULATION AND THE REGULATOR
ALFI welcome address
Opening by the Chairperson of the day
Emerging with the 12th edition of its session “regulatory update”, the European asset management conference is making this panel a tradition! Today’s discussion will give you an all-encompassing, snappy, refreshing and comprehensive overview of nearly all major topics of interest to asset managers operating UCITS and alternative funds, taken from a Luxembourg perspective. It is considering both recent and upcoming regulations, with a mix of pure Luxembourg-centric developments such as circulars and FAQs from the CSSF, and new regulation stemming from the EU as well as from ESMA, and from other international policymakers. Just to raise expectations a little… performance fees, sustainable finance, eligible assets, ELTIF, MMFR or MAR– will all be discussed, not to mention some other 10+ different topics.
2021 will be the year of sustainable finance! Two weeks after the first major deadline in the implementation of SFDR, listen to the views of CSSF Director Marco Zwick, interviewed by Corinne Lamesch, Chairperson of ALFI. What are the first lessons learned and what are the next steps in implementing the European’s Commission Action Plan on financing sustainable growth? Listen to Marco Zwick’s insights on key regulatory and supervisory files impacting the asset management industry, such as ESMA’s CSA on costs and charges, liquidity risks and liquidity management tools, the review of the UCITS Directive and AIFMD, and the CSSF’s programme of activities for 2021.
ALFI Guidelines on AML/CFT
AML/CFT and KYC are topics which require strict adherence to the highest possible standards from all stakeholders in the industry. Five years after issuing the last version of their guidelines, professionals from ALFI and other relevant industry associations in Luxembourg have worked hard in order to entirely revamp and modernise their guidelines. Hear from our experts Evelyne Christiaens, Head of the Legal Department ALFI and Hema Jewootah, Conducting Officer, Chief Compliance Officer and MLRO Lombard Odier Funds (Europe) S.A. and Co-Chair of ALFI AML Working Group for a snapshot of key recommendations and practical insights, covering both diligence on assets as well as KYC on investors.
CSSF Circular 18/698 on the authorisation and organisation of IFMs in Luxembourg

What are the lessons learnt on the oversight of delegates? Is a tick the box oversight exercise effective or does it risk creating blind spots? Can an oversight be streamlined and automated to make it less resource-intensive by using new technologies? How does oversight reconcile with Group organisation?
