The ALFI Q&A on the impact of MiFID on investment funds was recently published to the attention of the Association’s membership. The breakfast meeting will provide members with an overview of the main issues addressed in this document with regard to product governance, inducements, costs and charges and suitability/appropriateness rules. It will also be the opportunity to exchange views on the first days of implementation of MiFID and to identify further questions to be discussed among the ALFI MiFID working groups over the next few months.

MiFID implementation – open discussion
Josiane specialises in all types of investment fund-related matters, for both traditional and alternative funds. She advises major international fund houses and asset managers, including U.S. and Asia-based clients.
As a highly experienced and versatile funds lawyer, Josiane advises on everything from the setting up of funds, eligible investments and investment restrictions to fund mergers (both domestic and international), demergers, liquidations and restructurings.
She has particular expertise on funds set up under the Undertakings for Collective Investment in Transferable Securities (UCITS) directives. She has assisted many funds and fund management companies on the necessary requirements from successive UCITS directives.
Florence Stainier is a Partner in the Investment Management practice of Arendt & Medernach S.A. where she specialises in legal and regulatory matters related to investment funds and management entities. She advises clients on the creation, structuring, marketing and operations of investment funds with a particular focus on UCITS, alternative UCITS, hedge funds and ETFs. She is participating in several working groups of the Association of the Luxembourg Fund Industry (ALFI) in particular relating to MIFID, Islamic finance and UCITS matters. Florence is a member of the Luxembourg Bar.
Olivia is the Head of MJ Hudson Luxembourg, also Conducting Officer in charge of portfolio management, marketing and corporate & governance services. She has been structuring, establishing and developing fund businesses in Luxembourg for 12 years. As well as working at Luxembourg’s premier law firms, Olivia gained additional practical and commercial experience dealing with the Luxembourg regulator, public authorities and service providers, in her role as Legal Distribution Compliance Officer and Head of Legal at Lombard Odier Funds’ Luxembourg office. Olivia is permanent member of Luxembourg regulator CSSF’s AIFM Committee and also serves on the MiFID working group of ALFI.
